AMENDMENT NO. 1 TO SETTLEMENT AGREEMENT The Parties1' entered into a Class Action Settlement Agreement and Stipulation as of September 26, 2005 and now desire to amend the Agreement to comport with the Court's Order of February 6, 2006 and to add an omitted term. Accordingly, the Parties though their respective counsel agree, pursuant to XII. B. of the Agreement, as follows:
1) The definition of "Agreement" as set forth in Section II.B. is hereby changed to mean the Class Action Settlement Agreement and Stipulation and all of its exhibits entered into as of September 26, 2005, and this Amendment No. 1 and its exhibits entered into as of February 9, 2006.
2) The definition of "Preliminary Approval Date," as defined in Section II.EE. of the Agreement, is hereby changed to mean the date of entry of the Court's Order attached hereto as Exhibit F-l.
3) Exhibit A to the Agreement is hereby replaced with Exhibit A-l, attached hereto.

4 I. THE ACTION
5 Plaintiff Adam D. White filed a Complaint on February 26, 2004, and a First Amended
6 Complaint on March 26, 2004 against FAS asserting individual and putative class claims
7 alleging violations of the FCRA, the NYFCRA, and GBL § 349 in a case captioned Adam D.
8 White v. First American Registry, Inc., Case Number 1:04 CV01611 ? FAS answered the
9 Complaint denying all liability with respect to all of the claims asserted against it and asserting
10 many legal defenses to all of the claims asserted by Plaintiff Adam D. White.
